Collection Methods:

Preliminary Analysis - Upon receipt of any specific case or cases, the case is analyzed for the appropriate action. Initially a demand letter will be sent. Upon waiting the appropriate time we will either recommend immediate legal action or we will send a final letter. The factors considered at this stage include:

A. The amount of the claim.
B. Whether the debtor's address has been verified.
C. The debtor's apparent assets

Prejudgment Legal Action in New York - Legal Action will be commenced in the appropriate Town, Justice, Civil, District, or Supreme Court depending on the jurisdiction involved. We will have the debtors served and move expeditiously to the entry of judgment, if possible. The judgment will include the prinicpal balance owed plus any court costs allowed and necessary interest accrued.

Post Judgment Action - Once a judgment is entered, we will take all appropriate action under the law to collect on the judgment.

Old Judgment Review - All judgments not initially collected are reviewed on a periodic basis for asset searches.

Monthly Payment System - Many of "our" debtors pay on a month to month basis. These scheduled payments are monitored for default and remedial action is taken when necessary immediately upon default.

Lump Sum Settlements - Lump sum settlements are negotiated and encouraged if acceptable to client.

“Hands On” - Phone Contact with Client........All phone calls are returned promptly.

Computer System:

Cember & Cember, P.C. (C.& C., P.C.) in conjunction with Computer Assist, Inc., our computer consultants, utilize a multifaceted computerized collection system, called CAMS (Collection Agency Management Software). This software allows us to perform many functions concerning the everyday operations of our firm. The following is a list of those functions.

  1. Maintains a client profile on each client including but not limited to their address, phone number, contact person, rate of collection, etc.
  2. Maintains a debtor profile on each case including but not limited to name address, phone number, ss#, co-obligors, client's case #, dates of last payment to client and to Cember & Cember, P.C., balance received from client, collection fees, amount paid to date, current balance, interest accrued, county and Index number of litigation, current judgment with date entered and amount, specifics of voluntary payment arrangements, debtor's payment history, trigger date for future payments, flash boxes for very important warnings concerning each debtor (i.e.: FDCPA allegations, bankruptcies, special client interest.)
  3. Allows the posting of payments each day on each debtor to each client with the corresponding rate charged by C.& C., P.C. producing a payment sheet for each day.
  4. Allows for the reversal of bounced checks and other mistakes or incorrect data entry while maintaining the continuity of the entire program.
  5. Allows for the computation of fees for direct payments to the client on the monthly remittance while eliminating unnecessary billing.
  6. Remits to the client once a month unless the client requests an “On Demand” remittance which can be made at any time. Such remittances indicate the date and amount of each payment, the current balance of each debtor, your account number, as well as all direct payments.
  7. Can produce status reports for the client for any time period including first payments, settlements, closeouts, bankruptcies, etc.
  8. Automatically acknowledges receipt of all cases received by the firm from the client.
  9. Allows for the importing and the exporting of files from our system to yours.
  10. Allows for a “cardless” system of collection notes for each debtor. Of course, all legal cases do have a file with legal papers as well as correspondence.
